Este artigo busca: a) apresentar uma introdução histórica ao direito natural clássico, apontando suas principais características; b) investigar em que medida tais ideias tem influenciado a filosofia do direito contemporânea, perquirindo, assim, se há atualidade no estudo daquelas antigas concepções. A partir das ideias clássicas, será possível estudar como autores contemporâneos como John Finnis as utilizam na construção de um renovado jusnaturalismo que dialoga criticamente com positivistas como Hart e Raz, demonstrando a atualidade de tal estudo ao sustentar a impossibilidade (...) de se descrever o direito de modo neutro ou avalorativo. O presente texto tem por objetivo demonstrar como a aplicação do positivismo presumido de Frederick Schauer contribui para o desenvolvimento do Estado Democrático de Direito a partir manutenção da separação de poderes, ao impedir a realocação de Poder especificamente no bojo do judiciário, quando este interpreta as regras de competência constitucionais. Assim, busca responder à seguinte pergunta: em que medida o positivismo presumido pode contribuir para impedir que juízes “sedentos por poder” alcancem seus objetivos?

Are the ideas of democracy and isonomy an absolute achievement of civilization, or just a tuning moment in a complex system of metamorphosis? Is this something universal or an aesthetic approach? Could our concept of art, in its deepest sense, be responsible for democracy? Or, could our concept of democracy exist because of art? This paper is a reflection on these questions. Normally, a scientific text should give answers but would this principle be universal? Inside our planetary metamorphosis all values (...) are changing as always but now at high speed. High speed gives us both the sensation of confusion, which was typical in other historical moments, as when Carmina Burana was elaborated in the Middle Ages, and the possibility to take a step back and have, in the eye of the cyclone, dynamic elements showing us change in process. A new type of neuronal cell was discovered a few years ago: the mirror neurons. Their existence is a disturbing fact for our conceptions of intelligence and memory, giving to the whole universe of mind understanding a new logical framework. The impact of such a discovery on our concept of aesthetics and philosophy of thought makes us to recall Peirce, Lupasco, Buckminster Fuller launching ourselves to field folds, the super-string model or black holes among other non-linear time and space complexes.

Este dossiê representa a continuidade de um projecto centrado no património dos agentes ligados à produção, circulação e recepção do livro. A partir da história e dos espólios de empresas editoriais e de coleccionadores, bibliófilos e/ou divulgadores, a introdução problematizante e os depoimentos convocam a memória dos agentes e debatem as ameaças que pendem sobre essa herança cultural riquíssima e possíveis soluções. As boas práticas de vários países impõem uma reflexão inadiável para o contexto português: que vias de cooperação inter-institucional (...) concretas para garantir o depósito, tratamento e comunica­ção duma dimensão fulcral do património e da memória colectiva. A relevância desta ques­tão deve-se a estar inextricavelmente ligada a um reconhecimento sustentável do estatuto patrimonial e histórico dos acervos dos editores e doutros agentes ligados à edição e ao livro enquanto espaços vitais para a construção da cultura impressa e para a história do livro e da edição. De conteúdo exclusivamente matemático, seu texto responde a uma questão de probabilidade aplicada a jogos de apostas em que é preciso preservar, para todos os jogadores, a mesma chance de ganhar. Para isso, apresentaremos o contexto histórico e exporemos detalhadamente o uso e o sentido da terminologia empregada por Espinosa ao longo de suas explicações. Emotional intelligence is a psychological skill that aids athletes in the control of emotions and optimization of sports performance. The present study investigated the psychometric properties of the Self-Report Emotional Intelligence Test in 508 Brazilian youth and adult athletes. Data analysis was conducted through Exploratory and Confirmatory Factor Analysis, Cronbach’s alpha, composite reliability and Pearson’s Correlation. EFA revealed the one-factor model with 26 items with the best adjustment. CFA confirmed the one-factor model with 26 items with best greater fit. No (...) evidence of invariance was found, suggesting that the SSEIT must be used with caution when comparing gender and age groups. The external validity was found in the correlation of EI and cognitive anxiety and self-confidence. It is concluded that the Brazilian version of SSEIT for the sports context presented acceptable psychometric properties, however, showed limitations that should be explored in the future. (shrink)

The belief in miracle, as a modality of spiritual/religious coping strategy in the face of stress and psychic suffering, has been discussed in psychological literature with regard to its positive or negative role on the health and well-being of patients and family members. In contemporary times, where pseudo-conflicts between religion and science should have been long overcome, there is still some tendency of interpreting belief in miracle – as the possibility of a cure granted by divine intervention, modifying the normal (...) course of events in a bleak medical diagnosis – as having unhealthy impacts in the care and treatment of health. This position seeks to find a base in the three characteristics of hoping in a miracle, frequently pointed out by psychological literature: it would imply a negation of reality instead of its confrontation; it would be a coping strategy focused on emotion instead of the problem; it would imply seeking to modify the supposed desire of God by extra-natural facts. In this study, we shall critically discuss this position and the dangers of its crystallization by the use of SRC scales in which the act of praying for a miracle is previously classified as a negative strategy. We revisit some tendencies in psychological literature about the subject, taking into consideration the various facets of miracle, sociocultural facts, elements of idiographic nature, and their profound outcomes in the lives of people especially in health contexts. We illustrate the dangers of a hasty generalization of the results of nomothetic studies about the role of belief in miracle with two examples of research in the Brazilian context: one carried out with pregnant women with fetal malformation and the other with family members caring for children and adolescents with cancer under chemotherapeutic treatment. In both studies, the results do not confirm the predominance of the negative aspects associated with the act of praying for a miracle, which we discuss and analyze in light of the phenomenological perspective. In this perspective, “pray for a miracle”, as experienced by patients and caregivers, can be recognized as an act of openness to life, bolstering hope, and the resignification of reality in the psyche. This paper aims to analyze the poem "Psychology of Composition" by João Cabral de Melo Neto, seeking to comprehend poetry and poetic creation through the phenomenon of language as understood by Martin Heidegger.

Glucagon-like peptide-1 (GLP-1) receptor agonists, such as semaglutide, and dual GLP-1 and glucose-dependent insulinotropic polypeptide (GIP) receptor agonists, such as tirzepatide, have been found to be effective for treating obesity and diabetes, significantly reducing weight and the risk or predicted risk of adverse cardiovascular events. There is a global shortage of these medications that could last several years and raises questions about how limited supplies should be allocated. We propose a fair-allocation framework that enables evaluation of the ethics of current (...) practices and could guide governments, professional societies, and physicians in allocation decisions. Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. Four ethical values — maximizing benefits, treating equally, promoting and rewarding instrumental value, and giving priority to the worst off — yield six specific recommendations for allocating medical resources in the Covid-19 pandemic: maximize benefits; prioritize health workers; do not allocate on a first-come, first-served basis; be responsive to evidence; recognize research participation; and apply the same principles to all Covid-19 and non–Covid-19 patients.

Sometimes speakers try to lie and inadvertently assert something true. Subjectivists about lying hold that such speakers are lying despite telling the truth. Objectivists hold that such speakers are not lying: they try to lie but fail. The first aim of this paper is to point to novel cases supporting subjectivism that do not involve speakers inadvertently asserting something true. Its second aim is to use these and other cases to explore the distinction between lying and trying to lie. Which (...) factors can thwart an attempt at lying? In which situations do we judge that a speaker has tried to lie but failed? Attending to these questions not only offers insights into the act of lying, but also helps to scrutinise the objectivist strategy of explaining away intuitions about apparent cases of lying while telling the truth. In arguing against a supposed ambiguity, philosophers often rely on the zeugma test. In an application of the zeugma test, a supposedly ambiguous expression is placed in a sentence in which several of its supposed meanings are forced together. If the resulting sentence sounds zeugmatic, that is taken as evidence for ambiguity; if it does not sound zeugmatic, that is taken as evidence against ambiguity. The aim of this article is to show that arguments based on the second direction of (...) the test are misguided: ambiguous expressions, and in particular philosophically contested ones, do not reliably lead to zeugmaticity, so an absence of zeugmaticity provides no meaningful evidence for an absence of ambiguity. In several recent papers and a monograph, Andreas Stokke argues that questions can be misleading, but that they cannot be lies. The aim of this paper is to show that ordinary speakers disagree. We show that ordinary speakers judge certain kinds of insincere questions to be lies, namely questions carrying a believed-false presupposition the speaker intends to convey. These judgements are robust and remain so when the participants are given the possibility of classifying the utterances as misleading or as deceiving. (...) The judgements contrast with judgements participants give about cases of misleading or deceptive behaviour, and they pattern with judgements participants make about declarative lies. Finally, the possibility of lying with non-declaratives is not confined to questions: ordinary speakers also judge utterances of imperative, exclamative and optative sentences carrying believed-false presuppositions to be lies. This paper is concerned with fictive utterances, the authorial utterances that make up works of fiction. It is widely held that fictive utterances cannot be constative speech acts, such as assertions. Instead, fictive utterances are construed as pretended speech acts, as invitations to make-believe or as declarations. My aim is to challenge the non-constative consensus and to defend a view on which fictive utterances are constative speech acts after all, namely constatives that have a story as their target. I motivate (...) the constative view by discussing works of fiction that feature plot twists. Some of these plot twists indicate that fictive utterances can carry assertoric commitment and can be lies, contrary to what is commonly assumed. And I spell out a version of the constative view that takes cues from Stalnaker’s common ground account of assertion and the debate on commitment and responsibility in constatives. (shrink)

During the WHO-GloPID COVID-19 Global Research and Innovation Forum meeting held in Geneva on the 11th and 12th of February 2020 a number of different ethical concepts were used. This paper briefly states what a number of these concepts mean and how they might be applied to discussions about research during the COVID-19 pandemic and related outbreaks. This paper does not seek to be exhaustive and other ethical concepts are, of course, relevant and important.

We argue that charging people to participate in research is likely to undermine the fundamental ethical bases of clinical research, especially the principles of social value, scientific validity, and fair subject selection.

In a recent paper, Stefan Wintein criticizes my responses to the objections he raised to my modal-epistemic argument (MEA) for the existence of God. In this paper, I continue our debate and respond to Wintein’s criticisms of my previous responses. I argue that Wintein’s criticisms are unsuccessful. As a result, the MEA still stands.

Conscious experiences in infants remain poorly understood. In this NeuroView, Passos-Ferreira discusses recent evidence for and against consciousness in newborn babies. She argues that the weight of evidence from neuroimaging and behavioral studies supports the thesis that newborn infants are conscious.

Even though the talk of causal bases is commonplace in traditional and contemporary discussions about dispositions, the concept of causal bases has never been systematically investigated. This paper aims to fill this gap by developing the causal-grounding account. This account takes two roles as definitory for causal bases. First, causal bases are possible causes of disposition manifestations. Second, causal bases are metaphysical grounds of disposition instantiations. In this paper, we show that the causal-grounding account (CGA) achieves crucial distinctions (for example (...) between causal bases and manifestation conditions), captures relevant traditional features of causal bases, and can be invoked to support the causal efficacy of disposition instantiations. At the same time, CGA does not require that causal bases have to be categorical or intrinsic. This, in turn, allows us to remain neutral concerning fundamental properties, the existence of dispositional or extrinsic causal bases, multi-track dispositions, and the reducibility of dispositions. This neutrality grants the suitability of our account for different philosophical projects and discussions. (shrink)

An increase in global violence has forced the displacement of more than 70 million people, including 26 million refugees and 3.5 asylum seekers. Refugees and asylum seekers face serious socioeconomic and healthcare barriers and are therefore particularly vulnerable to physical and mental health risks, which are sometimes exacerbated by immigration policies and local social discriminations. Calls for a strong evidence base for humanitarian action have encouraged conducting research to address the barriers and needs of refugees and asylum seekers. Given the (...) role of epigenetics factors to mediate the effect of psychological and environmental exposures, epigenetic modifications have been used as biomarkers for life adversity and disease states. Therefore, epigenetic research can be potentially beneficial to address some of the issues associated with refugees and asylum seekers. Here, we review the value of previous and ongoing epigenetic studies with traumatized populations, explore some of the ethical challenges associated with epigenetic research with refugees and asylees and offer suggestions to address or mitigate some of these challenges. Researchers have an ethical responsibility to implement strategies to minimize the harms and maximize the short and long-term benefits to refugee and asylee participants. (shrink)

COVID-19 vaccines are likely to be scarce for years to come. Many countries, from India to the U.K., have demonstrated vaccine nationalism. What are the ethical limits to this vaccine nationalism? Neither extreme nationalism nor extreme cosmopolitanism is ethically justifiable. Instead, we propose the fair priority for residents framework, in which governments can retain COVID-19 vaccine doses for their residents only to the extent that they are needed to maintain a noncrisis level of mortality while they are implementing reasonable public (...) health interventions. Practically, a noncrisis level of mortality is that experienced during a bad influenza season, which society considers an acceptable background risk. Governments take action to limit mortality from influenza, but there is no emergency that includes severe lockdowns. This “flu-risk standard” is a nonarbitrary and generally accepted heuristic. Mortality above the flu-risk standard justifies greater governmental interventions, including retaining vaccines for a country's own citizens over global need. The precise level of vaccination needed to meet the flu-risk standard will depend upon empirical factors related to the pandemic. This links the ethical principles to the scientific data emerging from the emergency. Thus, the FPR framework recognizes that governments should prioritize procuring vaccines for their country when doing so is necessary to reduce mortality to noncrisis flu-like levels. But after that, a government is obligated to do its part to share vaccines to reduce risks of mortality for people in other countries. We consider and reject objections to the FPR framework based on a country: having developed a vaccine, raising taxes to pay for vaccine research and purchase, wanting to eliminate economic and social burdens, and being ineffective in combating COVID-19 through public health interventions. Machery argues that concepts do not constitute a natural kind. We argue that this is a mistake. When appropriately construed, his discussion in fact bolsters the claim that concepts are a natural kind.

It is well known that Frege's system in the Grundgesetze der Arithmetik is formally inconsistent. Frege's instantiation rule for the second-order universal quantifier makes his system, except for minor differences, full (i.e., with unrestricted comprehension) second-order logic, augmented by an abstraction operator that abides to Frege's basic law V. A few years ago, Richard Heck proved the consistency of the fragment of Frege's theory obtained by restricting the comprehension schema to predicative formulae. Narcissism is a truly Janusian phenomenon, consisting of both narcissistic grandiosity, exhibitionism, admiration-seeking, boldness, and dominance on the one hand, and narcissistic vulnerability, introversion, withdrawal, hypersensitivity, and anxiety on the other hand. While there is broad consensus that these two seemingly contradictory faces of narcissism can be empirically discerned and have different implications for psychological functioning and mental health, there is not yet agreement on whether grandiose and vulnerable narcissism should be regarded as independent traits or as two manifestations of (...) one personality trait. Previous research indicates that both views hold true when the level of grandiosity is considered a moderating factor: while grandiose and vulnerable narcissism are largely unrelated in the range of normal personality variation, they are correlated in the range of high grandiosity ( Jauk et al., 2017b ). Here, we replicate and extend this work in an independent sample ( N = 891) using a more comprehensive narcissism inventory grounded in a new trifurcated model of narcissism. The trifurcated model partitions narcissism into three main personality dimensions: agentic extraversion, antagonism, and neuroticism. We found a significant breakpoint in the association between narcissistic grandiosity and vulnerability at 75% cumulative frequency of grandiosity. While grandiosity and vulnerability are unrelated below this breakpoint ( r = 0.02), they are strongly correlated above ( r = 0.45). In the lower range of grandiose narcissism, grandiosity draws more upon agentic extraversion and is largely associated with mental health. In the upper range, however, grandiosity is more strongly linked to antagonism and is substantially associated with fear, negative affect, and depression. These findings provide evidence for the view that grandiose and vulnerable narcissism are distinct traits at lower levels of grandiosity, but blend into an antagonistic core with signs of psychological maladjustment at higher levels. Implications for research on narcissism as a personality trait, as well as clinical practice, are discussed. (shrink)

We construct a weak second-order theory of arithmetic which includes Weak König's Lemma (WKL) for trees defined by bounded formulae. The provably total functions (with Σ b 1 -graphs) of this theory are the polynomial time computable functions. It is shown that the first-order strength of this version of WKL is exactly that of the scheme of collection for bounded formulae.

I propose a new argument for the existence of God. God is defined as a conscious being that is the first cause of reality. In its simplified initial form, the argument has two premises: all possible truths are knowable, and it is impossible to know that the proposition that God does not exist is true. From and it follows that the proposition that God exists is necessarily true. After introducing the argument in its crude initial form and laying out the (...) core intuitions behind its premises, I point to two difficulties that this simplified version faces. I then go on to show how the argument can be revised to handle these difficulties. I defend the revised argument from various objections. (shrink)

Dissent is thought to play a valuable role in science, so that scientific communities ought to create opportunities for receiving critical feedback and take dissenting views seriously. There is concern, however, that some dissent does more harm than good. Dissent on climate change and evolutionary theory, for example, has confused the public, created doubt about existing consensus, derailed public policy, and forced scientists to devote resources to respond. Are there limits to the extent to which scientific communities have obligations to (...) seek and engage dissenting views? We consider the two main criteria that have been offered for what constitutes “normatively appropriate dissent” or the sort of dissent that ought to have the opportunity to be heard and taken seriously. Many have argued that dissenters must (1) engage in uptake of criticism against their own views and (2) share some standards for theory appraisal. We argue these criteria ultimately are unsuccessful. In several recent papers, Daniel Deasy has argued that the presentism–eternalism debate is unclear and should be abandoned. According to Deasy, there is no way of spelling out the predicate ‘is present’ that leads to a satisfactory definition of presentism: on some interpretations, presentism turns out to be compatible with eternalism, on others, it is clearly false or unacceptable for other reasons. The aim of this paper is to show that this line of argument should be resisted: if the predicate (...) ‘is present’ is spelled out in terms of where things are located, the result is a definition of presentism that is neither compatible with eternalism nor clearly false. There is thus no need to abandon the debate between presentists and eternalists. (shrink)

O primeiro tópico lança o substrato epistemológico sobre a existência das racionalidades estratégica e comunicativa. O segundo, afirma que o desengate entre o sistema e o mundo da vida, e a colonização deste por aquele, causam as patologias modernas e colaboram para a formulação de pedagogias coordenadas pela ação estratégica. O terceiro, propõe que o reacoplamento do sistema ao mundo vivido proporciona que (...) todas as dimensões da existência humana sejam orientadas pela ação comunicativa, na qual se encontram os traços de uma paideia emancipadora e revolucionária. The understanding of a wide array of practices related to fraud, bribery, corruption, and more widely, illicit practices have been capturing the attention of practitioners and management researchers worldwide. A substantial portion of the extant research has used university students to measure their actual or intended cheating behaviours and often studies have tested for variations across countries and cultures. We highlight some major concerns in this stream of inquiry and discuss both the definition and some inconclusive results in prior studies, (...) namely those deriving from differences in cheating behaviour across different cultural contexts. We suggest the need to examine intentionality, and further advance that intentionality may assume a reactive or a proactive essence. Depending on the social and formal contexts of different countries, both reactive and proactive intentions lead to distinct moral concerns, which we name in this work omorality (meaning ‘our morality’) or immorality (in the traditional sense). We present a functional interpretation of Peano arithmetic that uses Gödel’s computable functionals and which systematically injects uniformities into the statements of finite-type arithmetic. As a consequence, some uniform boundedness principles are interpreted while maintaining unmoved the -sentences of arithmetic. We explain why this interpretation is tailored to yield conservation results.

Despite many attempts to achieve an adequate definition of living systems by means of a set of necessary and sufficient conditions, the opinion that such an enterprise is inexorably destined to fail is increasingly gaining support. However, we believe options do not just come down to either having faith in a future success or endorsing skepticism. In this paper, we aim to redirect the discussion of the problem by shifting the focus of attention from strict definitions towards a philosophical framework (...) that allows conceiving of living systems as a natural kind, but whereby natural kinds are not to be defined by fixed necessary and sufficient conditions. We argue for a property-cluster kind approach according to which living systems constitute a natural kind with vague boundaries, capable of changing, and whose members do not need to instantiate every property. We draw from Boyd’s homeostatic property-cluster theory and introduce two modifications, one regarding homeostatic mechanisms and another related to the scientific role of kinds. Thus, our view overcomes some difficulties of Boyd’s theory and we are able to account for the natural kindhood of living things. We also emphasize the most appealing features of our approach for specific research fields and address three objections to this sort of approach. (shrink)
